General


In this article, we will provide an overview of Bay Favors' practices and policies regarding customer and client interactions with the company through our websites at https://www.bayfavors.com/ and the sharing of personal and business-related ordering and shipping information (referred to collectively as "Users"). Throughout this document, "we", "our", or "the Company" will be used to refer to Bay Favors.

Placing an Order


The majority of the items shown on the website are for Retail Consumer sales. Orders are handled by various printing companies and are processed according to their high standards. You will be able to see ( in a separate tab ) the exact print job timeframe, estimated delivery times, and payment method for each selection.

For the Distributors, Company Stores, Team Sports, and Commercial Business Sectors, we will send you a presentation/spec sheet, with a logo or graphic art mockup, of the desired product. This will be after approving your account. Whole pricing catalogs for teams and stores are available depending on your industry.


Delivery


Please follow the corresponding ordering instructions regarding the item selected to ensure fast and efficient delivery. Orders are handled by various printing companies and are processed according to their high standards. You will be able to see ( in a separate tab ) the exact print job timeframe, estimated delivery times, and payment method for each selection.

Please read the information area on each item regarding processing time, delivery restrictions, and relevant shipping disclaimers. Not all items are shipped from the same printer.

Returns & Refunds


In most cases, Retail Consumer items have a limited warranty. Before you make a purchase, please review the item's policy and check the article's size requirements to ensure your satisfaction. In the event that the wrong color or size is ordered, we cannot be held responsible.


For Distributor and Wholesale orders, if you are unhappy with your order because the product is defective or the imprint quality isn't what you expected, please contact us immediately at contact@bayfavors.com. We will resolve the issue. The experience you have with Bay Favors is extremely important to us, and we will do our best to resolve any issues you may have. We need to be notified within 15 days of any issues.

Returns are only accepted for defective apparel and defective decoration (embroidery, printing, engraving, etc.). Our goal is to assist you, within reason, as much as we can.

The artwork, designs and trademarks shown on products on our site are examples of the products and imprinting services we offer from hundreds of brands. However, they may not represent endorsement by the owners of the artwork, designs, or trademarks.


Pricing for Retail Consumer Merchandise vs. Distributor Products

We offer free US shipping on many retail-ready lines of merchandise and discounted rates for international zones. Bay Favors produces custom-designed items using many sources throughout the US and sells direct to consumers as well as distributors. A retail consumer item is priced per unit; in most cases, wholesale quantities are available for distributors and companies. By choosing the most suitable technique using sublimation, heat transfer, DTF, and embroidery on apparel, and laser and other logo print processes on hard substrates, Bay Favors is able to fulfill a vast variety of premium items from top designer lines. Because of this, production can range from 1-5 days under normal circumstances. Some items may be sourced from other countries and printing may add additional days.


Retail Consumer Pricing differs from Distributor Promo Pricing in that the latter involves volume purchasing with minimum order requirements. Online and catalog pricing are shown for general resale purposes to distributors and businesses. Bay Favors account members' net priceThe pricing for Retail Consumers is different from the pricing for Distributor Promotions, as the latter involves buying in large quantities with minimum order requirements. The prices shown online and in catalogs are for general resale purposes to distributors and businesses. The net prices for Bay Favors account members can be found on the presentation/spec sheet listed up to the indicated date. Prices are not confirmed until the final prices are verified with factories at the time of order submission due to fluctuations in factory prices and import tariffs. All items are priced at the time of fulfillment. At that point, you can either approve the current price or choose not to order the item(s).


ORDERING TERMS & CONDITIONS OF SALE

NO minimum order on Retail Consumer and most blank / undecorated Distributor products, dependent of limitations on Branded and Private Label apparel and giftware (see Brands). Discounts are given on most products at various quantity levels.


Prices may be subject to change without prior notice. Bay Favors will not be held responsible and shall not be liable if notifications regarding price changes are not received. The availability of merchandise may change or be temporarily or permanently out of stock. We do not accept liability for any delays or unsuccessful deliveries caused by our inability to procure supplies.


All sales made by Bay Favors ("Seller") to you ("Customer") are governed by these Terms of Service for Consumer and Retail Sales (TOS) unless otherwise indicated by Bay Favors in writing. Reference to this TOS "Ordering Terms and Conditions of Sale".


Please read this complete Bay Favors Ordering Info before placing your order.  Do not place any orders unless you understand and agree to all Ordering Terms and Conditions and matter outlined herein.  Bay Favors reserves the right to amend or modify these Ordering Terms and Conditions of Sale at any time and without notice at its sole discretion.


The Customer's acceptance of Bay Favors Ordering Terms and Conditions of Sale is a prerequisite for all sales.


Seller shall not accept Customer's purchase orders unless and until Customer consents to these Ordering Terms and Conditions of Sale.  These Ordering Terms and Conditions of Sale (as set forth on this website) supersede the terms and conditions of Customer's purchase order(s) and will govern all transactions between Customer and Seller.  These Ordering Terms and Conditions of Sale also apply to all future transactions unless modified in writing and signed by Seller and Customer.


Bay Favors is happy to receive your orders in written form, over the phone (with subsequent written confirmation), or through electronic means for web-based orders. Please note that once Bay Favors accepts an order, it cannot be cancelled or refunded without their consent. However, if an order is shipped incorrectly or is defective in production or print, it may be eligible for return (see Returns). All sales are considered final and non-returnable, except in these specific circumstances.

 

ACCOUNT CUSTOMERS

In order to place an order for branded and printed items at Bay Favors, a customer account is mandatory. Please note that we do not offer credit services, and therefore, we only require shipping information, without collecting any other data.


Bay Favors will sell Branded and Private Label products only to authorized account customers who, in the sole discretion and judgment of Bay Favors, will not market or sell in any way that disparages, misrepresents Branded or Private Label products or employing any undesirable or negative selling practices deemed so by said Branded or Private Labels.


NOTE: The following pertains mainly to Promo / Distributor orders. However, single item imprinted orders are enforced under these same terms as follows.


CUSTOM DECORATIONS

All prices shown are clearly noted. Artwork if provided by Bay Favors and set up fees, print fees, handling fees, product pricing… etc. are stated within each item description and subject to local/state sales tax laws.

Typical over/underruns do occur with factories and range 5-10 percent dependent on product. Quantities shipped the given factory percentage under the quantity ordered will be considered fulfillment of the order.

All artwork is subject to final approval with a signed layout proof.

When submitting prepared artwork, files must be print ready preferably in vector EPS format and each file converted to curves. Layered files and 2 or more colors must be separated for many 4-color print shops. Camera ready, enlarged B&W suitable for most spot color printing. Formats differ with factories; clarification is available depending on item. Artwork will be proportionally resized to fit maximum imprint area unless otherwise specified within the art file via crop marks or another notation.

Because of differences in equipment, media, inks, and other conditions, some variations will occur between proofs and finished product. These variations are explained on your proof form.

Production time is estimate (not guaranteed) from factories and starts after order / artwork is finalized. Delivery is to you once order arrives and is checked for accuracy. In some cases, orders are dropped shipped directly to you.

All artwork created by Bay Favors is either approved for creative common free rights usage or licensed to or by Bay Favors either by trademark, copyright, patent or personal usage in compliance with laws; or designed exclusively by Bay Favors and is subject to copyright.

BF Anchor Designs: Prices shown for each item include artwork by Bay Favors limited to design collection suitable for said item and is included in price accordingly.

Additional custom art, redesigned art, altered images, proof changes, imprint color change, separations – all work perform by Bay Favors charged at current rate contingent of job classification itemized from $25-65/hr.

Artwork

To deliver the highest quality imprint possible, we require vectors or high-resolution (300-600 DPI) designs. Our professional artists will attempt to recreate or clean all artwork submitted that does not meet the resolution requirements.

  • Please note added work involving cleaning or recreating any artwork will result in order delays. If Bay Favors is not able to properly edit or recreate a low-resolution file, attempts to contact you will be made to resolve the issue. If unable to reach you, your order will be subject to cancellation and a refund will be issued within 15 business days. Bay Favors will not be responsible for production delays resulting from submitted low-resolution images.

 Bay Favors reserves the right to refuse printing of any artwork that may be deemed inappropriate, offensive, copyrighted, or trademarked.


 Formats

We accept a wide variety of file formats to print your design. Listed below are our preferences:

Adobe Illustrator files (.ai, .eps)

Adobe Photoshop files (.psd)

Rasterized images meeting 300-600 dpi minimum requirement (.jpg, .png, .tiff)

All full color artwork should meet our minimum resolution requirement of at least 300 dpi

All fonts/text must be included with your file or converted to outlines.

All artwork containing copyrighted images will be subject to further screening.

Customers will assume complete responsibility to obtain permission for reproduction of logos, patents, trademarks, and copyrights. By agreeing to print any submitted artwork, Bay Favors will not be held liable under any circumstances.

All artwork containing Greek and University assets will be subject to further screening.

 

Imprint Area

Several factors are taken into consideration when determining the imprint area on a product. Generally, we will adjust artwork as requested unless it exceeds the imprint area of a given item. Additionally, requests to exceed our listed imprint areas will not be granted.

Please note Bay Favors will not be held responsible for illegible or filled-in imprints resulting from requests that do not meet our minimum imprint area requirements.

 

Imprint Methods

Depending on item and factory, Bay Favors offers a series of decoration styles to fit the needs of your design and order details. The most used methods are Screen Printing, Digital Printing and Embroidery. Others include Seamless Heat Transfer, Laser Engraving, Laser Etched, Debossing, – Unless selected, method will be selected by experienced staff members on a case by case basis.

Screen Printing

Screen-printed items are customized using "direct-print" machinery. Due to its accuracy during application, this method is preferred for 1 color imprint jobs.

Digital Printing

Most orders containing 2 imprint colors or more will be processed using one of our digital methods. Your design will be printed on a decal paper, using a CMYK build of your art colors, which will later be applied by hand to your products.

Manual application of the decals may result in some art placement variations.

Laser Engraving

During this process, a laser removes material from the surface of an object and makes a permanent mark. Therefore, color laser engravings are not available.

Please contact our Sales Department with questions about this decoration method and second side engraving options. Additional charges may apply to your order.

Debossing

Debossing is recommended for use on leather, faux leather, and other synthetic polymer products. A zinc plate is molded with your artwork, loaded into our press, and applied to the product using heat and pressure.

Embroidery

Embroidery decoration is available on many apparel items and some tote bags. Your artwork is first digitized by one of our professional artists and later applied by state-of-the-art embroidery machines. We allow an average of 10,000 stitches and 16 thread colors per design.

Colors

Bay Favors offers various standard imprint colors and can print custom colors from the Pantone Solid Coated PMS Colors Book. When choosing your imprint colors, we suggest you keep the following in mind:

  • Light colors should be printed on dark items to contrast properly.
  • Dark colors should be printed on light items to contrast properly.
  • Laser is not offered as a color but will show as the underlying product material color. For example, a blue stainless-steel item may show as silver when engraved.

Please note we will not question your imprint color choices. Our artists may contact you to resolve concerns surrounding a mistake.

 

Proofs

Bay Favors will provide an email proof if one is needed to verify imprint instructions, artwork or order details for customer ordered branded or imprinted merchandise. The Art Department also reserves the right to send a proof if your artwork needs to be altered to meet our printing requirements. If your proof is not approved within 14 days, your order may be printed as is.

Please note proofs are an approximation of the final product.

Changes to your proof must be in writing and submitted through our online approval/decline proof form. We may accept proof changes via phone in the event you experience technical difficulties with our online proof. If you do not require a proof, please ensure all artwork/logo submitted is correct.

Bay Favors will not be held responsible for incorrectly submitted artwork.

Once a proof has been approved, updated shipping and delivery dates will be issued. Keep in mind specific 'in-hands' dates are subject to change during the proofing process. Requesting a proof may delay production, thus jeopardize the likelihood of receiving your order in a timely manner.

Bay Favors will not be held responsible for delays resulting from the proofing process.


Proposition 65

Also known as the Safe Drinking Water and Toxic Enforcement Act of 1986, California Proposition 65 requires businesses provide warnings to Californians about exposure to chemicals that cause cancer, birth defects or other reproductive issues. Prop 65 does not ban any product; it simply requires a warning is issued. Prop 65 is valid in the State of California only and requires standards are met across all products distributed in the state. Please note Bay Favors complies with all federal regulations concerning chemical contents.

Accordingly, if a buyer/distributor fails to provide Bay Favors advance written notice that a Bay Favors' product will be sold or shipped to the State of California, such buyer/distributor hereby indemnifies and agrees to defend and hold harmless Bay Favors, its agents, employees, representatives and affiliated companies, from and against any and all Proposition 65, personal injury and property damage claims, and from all other costs, liabilities, damages and expenses (including, without limitation, attorneys fees and litigation expenses on account thereof or in connection with any investigation or preparation related thereto or the enforcement of this provision) relating to, resulting from, connected with or arising out of goods or products provided to buyer/distributor by Bay Favors, to the maximum extent permitted by law.

Any order placed with or received from Bay Favors, including but not limited to orders placed via catalog, online, phone or mail, shall be deemed effective acceptance of these terms.


PAYMENT

Online orders for Retail Consumer Pricing Gift Store items due at time of purchase/checkout


Note: Payment for Distributors / Promo Store is as follows: Depending on item, 40-60% of monies due at time of ordering with the remaining balance due at time of final acceptance of order by factory through these payment methods: Cash, Approved Business Check, Visa, MasterCard, Discover, and American Express. Once we pre-authorize your card, funds are collected within 24 hours of shipping. We offer a 2.2% discount on product for cash or check. Returns, adjustments, and cancelations subject to terms of each factory. Payment by PayPal is subject to approval for each invoice.

When paying for an order with a credit or debit card, Bay Favors will pre-authorize your card for the portion of your order that is shipping, along with applicable freight and sales tax, prior to processing your order. The full amount will then be charged to your card once your order ships. Pre-authorizations reserve the total dollar amount on your credit card (or funds available through your debit card) to pay for your order. Pre-authorizations will drop from your account within 1-7 days, depending on your card issuer.

Customers in certain states may be required to remit use taxes. If your organization is exempt, please supply a Bay Favors with your resale certificate prior to placing your order at orders@bayfavors.com.


SHIPPING

Customer is responsible for all shipping and freight charges UNLESS stated on order page or sales order. All products are shipped FOB or prepaid from various factory warehouses and/or decoration centers. Customer must notify Seller at time of purchase if a signature is required for residential deliveries. 

Shipping method is at Bay Favors discretion and may vary by location. We assume no liability for delays or failure to deliver due to our inability to obtain supplies.

It is your responsibility to check for discrepancies or defects in an order before any alterations or embellishments are made. Returns must be authorized by Bay Favors in advance for any defects or for reasonable request for returning products to factory for reasons mentioned in our policies.  


RETURNS

If you are unhappy with your order because the product is defective or the imprint quality isn’t what you expected, contact us at contact@bayfavors.com immediately upon receiving your shipment and we will find a suitable resolution. Your experience with Bay Favors is most important to us and we will do our best to work with you on any issue. We must be notified of all issues within 30 days.

The only returns we can accept are for defective apparel or defective decoration (embroidery, printing, engraving, etc.). However, we will try and help you out as much as we possibly can, within reason.
